Foreclosure risk notice
- 01
Sold as-is
Properties are sold in their current condition. The seller makes no repairs and provides no seller disclosures.
- 02
Inspection is usually not possible
Most properties cannot be entered before the sale. Interior condition, unpermitted work or structural problems may only come to light afterward.
- 03
Senior liens
Property taxes, certain government liens and senior mortgages may survive the sale and become the buyer’s responsibility.
- 04
Junior-lien sales
If the loan being foreclosed is a second-position loan, the buyer takes title subject to the first-position loan. Total cost can far exceed the winning bid.
- 05
Displacement by a post-sale bid
Under California SB 1079 and subsequent amendments, including AB 1957, certain eligible bidders on one-to-four-unit residential properties — such as tenants, prospective owner-occupants and qualified nonprofits — may submit a higher bid within a set period after the sale (up to 45 days) and displace the highest bidder at auction. Winning the auction is not the same as acquiring the property.
In addition, former owners or tenants may still occupy the property, and any removal must follow legal process; sales may be postponed or cancelled at short notice; and buyers are typically required to pay in full, in cash or by cashier’s check.
§ 3
